Terms of use for Beyond Medals, Inc.

The following terms of use (“Terms”) are applicable to all sales of products, materials, articles, documentation, and any other goods (“Product(s)”) made by Beyond Medals, Inc., a Delaware corporation with registered office located at 251 Little Falls Drive, Wilmington, DE 19808 (“We”, “Our” or “Us”), and the acceptance of any order is expressly conditioned upon your consent to these Terms. These Terms constitute the sole terms and conditions of the contract between you and us.  No other terms, conditions, or understanding, whether oral or written, shall be binding upon us. The Terms may change from time to time, in our sole discretion, which is why we kindly ask you to read them thoroughly in every instance before placing your order. Any change to the Terms shall be made available to you on our website.

By placing an order on our website, you accept to be bound by the Terms. The purchase is completed when you have received the order confirmation, and it is your responsibility to ensure that any information you have submitted to us – name, email address and postal address – is correct. You must be 18 years of age (or age 16 with the consent of a guardian), to shop in our online shop.

Should any provision of these Terms be judicially declared unenforceable, that provision shall be deemed stricken and the remainder shall continue in full force and effect insofar as it remains a workable instrument for effectuating our and your intents and purposes.

Payment

The payment will be processed by Adyen, which is a reliable electronic payments partner for Visa, Mastercard and several other payment services. Adyen gives you the same guarantees and peace of mind that you have when you buy something in a physical shop. The amount is reserved at the time of booking, but it is not debited from your account until the Product has been packed and sent. The payment pages are secured with SSL, and all card details are encrypted. This means that no one can read your card number, name or address when the information is sent over the internet.

Discount Codes

Discount codes are temporary offers which cannot be combined with other discount codes or offers. The applicable conditions and rates for the various discount codes are communicated at the website where you gain access to the discount code. In the event of unauthorized use of discount codes, we reserve the right to cancel the purchase.

Privacy Policy

We will not use your personal data for any other purpose than to provide the services required for your purchase. Please find our Privacy Policy at our Contact page.

Right of cancellation

You have the right to cancel the purchase at any time within fourteen (14) calendar days without citing any reason for doing so. The cancellation period begins from the date on which you receive your order. Please contact customer service to cancel your order.

Full refund

You get a full refund if you return your purchase within thirty (30) calendar days from the date of purchase. See the procedure under Return and Exchange.

If you change your mind after the package has been dispatched by us, you must pick up the package from the delivery point or accept receipt when delivered to your door, and return the Product to us, using the attached return slip.

Freight, Delivery and Returns

The normal delivery time is from two (2) to four (5) working days for delivery in the United States. However, any specific shipping date designated in writing signed by us shall be interpreted as estimated and in no event shall dates be construed as falling within the meaning of “time is of the essence”. We shall not be responsible for any delays in filling orders, nor shall we be liable for any loss or damages resulting from such delays regardless of whether such delays are due to force majeure or otherwise.

Return and Exchange

You have thirty (30) calendar days from the date of purchase to return or exchange the Product. After this period, the Product will be deemed accepted by you, and you will forfeit the right to any return or exchange. You are allowed to inspect Products carefully, but labels or tags must not be removed.

You must hand in your return to your local UPS/Fedex access point, whichever service you used for your initial order.  If you wish to change size or Product you simply return the original Product and place a new order.

To send your return back to the online shop use the return address label enclosed in your package. All returns to our online shop are charged return freight of USD 7.95. If the return is due to an error for which we are responsible, we will obviously cover the return freight charge.

If you return your Product, it may take up to ten (10) workdays to process a return back to our warehouse. We will refund the amount equivalent to the product value, and deduct the return freight of USD 7.95. The return amount will be refunded to the account which you used for payment. You are allowed to inspect Products carefully, but labels or tags must not be removed.

Right to Repair or Replacement

The right to repair or replacement is in effect for three (2) years. The right to repair or replacement does not apply to ordinary wear and tear, improper use, misuse or abuse by you (including but not limited to mishandling, neglect, modification or negligence), deterioration resulting from age, storage, weathering or lack of use, continued Product use after a fault or deficiency is discovered or should have reasonably been discovered or damage to Product caused by fire, storm or other Acts of God. Product showing only minor defects, not affecting the function of the Product shall be accepted by you and shall not give rise to any right. If a fault or deficiency is detected, you must notify us within a reasonable period of time after discovering or after you should have discovered the fault or deficiency, and indicate your intention to invoke the right to repair or replacement. We will assess what constitutes a reasonable period of time at our sole discretion. Nevertheless, the complaint period cannot exceed two (2) months from the time when you discovered or should have discovered the fault or deficiency. If you fail to file a complaint in time, you forfeit the right to invoke the right to repair or replacement.

If you wish to file a complaint concerning a Product, we would appreciate it if you would please send us a photo by email to info@beyondmedals.com first. This way, you are released from returning a Product that we might discard anyway. This will both be better for the environment and speed up the payment of any refund we owe you due to your complaint.

We reserve the right to reject an invalid complaint if it has been determined that the Product is not defective under current legislation.

Damage Incurred in Transit

If the package has been damaged in transit, contact info@beyondmedals.com as soon as possible.

Colors

We cannot guarantee that the colors you see on your screen depict the garment colors with complete accuracy. The colors are depicted according to user settings. Therefore, you may not invoke your right to repair or replacement for such reason.

Personal data

When you place your order, you approve that we save and use your personal data to complete and deliver the Product and to provide you with the service and shopping experience you expect. Read more about how we process your personal data in our Privacy Policy at our Contact page.

Prices & Charges

We will be entitled to adjust agreed prices on the basis of the average change in the cost price of the Product or services to be delivered by us.

The prices do not include freight or payment charges, or any present or future Federal, State or Local property, sales, use, excise, license, gross receipts or other taxes or assessments which may be applicable to, imposed upon or result from this transaction or any services performed in connection with these Terms and/or the Product.

Force majeure

If we experience a force majeure situation, i.e. if we or our business partners are subject to Acts of God, flood, drought, earthquake or other natural disaster, terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo or breaking off of diplomatic relations, nuclear, chemical, biological contamination or sonic boom, epidemic or pandemic, any law or any action taken by a Government or a public authority including without limitation imposing an export or import restriction, quota or prohibition, the collapse of buildings, fire, explosion or accident, or any event beyond our control, we reserve the right to cease to honor our obligations vis-à–vis you for up to two (2) months. After this period, we reserve the right to terminate the contract without being liable in damages.

Reservation for Cancellation

We reserve the right to terminate the contract if you act in ‘bad faith’ due to inaccuracies which you knew of or should have perceived as incorrect information about price or quantity on our website. In instances where the right to cancel a purchase is asserted, you may never be entitled to any right to compensation in damages.

Governing Law and Jurisdiction

These Terms and all transactions between you and us are governed by the laws of the state of Delaware, without reference to conflict of laws principles. The application of the United Nations Convention on the International Sale of Goods is expressly excluded. In the event of a dispute arising from or relating to these Terms, which is not resolved by negotiation between the parties, the parties hereby agree to exclusive personal jurisdiction in the state and federal courts located in Delaware.
